The Peninsula Township Board has scheduled a public hearing on “The 81” Development, the old Boursaw farm which borders Boursaw Road and Smokey Hollow Road, for the regular meeting of the Township Board on May 10, 2016. Read the official notice below.
In August of 2015, the Peninsula Township Board approved the development (read more here) with several conditions. This resulted in the organization of the nonprofit “Save the Outstanding Peninsula,” which serves to oppose non-conforming development and preserve the natural beauty of the Old Mission Peninsula.

The August decision by the Peninsula Township Board was challenged in court by the nonprofit, and on Dec. 21, 2015, the two parties went before Judge Philip Rogers of the 13th Circuit Court in Grand Traverse County.
In January, Judge Rogers ruled against the developer on proper soil erosion studies and emergency fire road. Another public hearing was held on March 15, where discussion took place and more information was requested. Here’s the official notice of the upcoming public hearing.

PLEASE TAKE NOTICE Per the decision and order of Judge Rogers of the 13th Circuit Court for Grand Traverse County made on January 15, 2016 in case number 2015-31218 AA with respect to The 81 on East Bay Special Use Permit application and the application for Planned Unit Development, the Peninsula Township Board will hold a public hearing at a regular meeting on May 10, 2016 at 7:00 PM at the Peninsula Township Hall, 13235 Center Road, Traverse City, MI 49686, (231) 223-7322 to review the following standards under the Peninsula Township Zoning Ordinance: Section 8.1.3 (1) (c), Section 8.1.3 (3)(d), Section 8.1.3 (3) (e), Section 8.1.3 (3) (h), Section 8.1.3 (3) (i); Section 8.1.3 (3) (j), and Section 8.1.3 (3) (n).
PROPERTY LOCATION: 15634 Smokey Hollow Rd. and 15636 Boursaw Rd., Traverse City, MI 49686 Section 29, Peninsula Township PARCEL ID #: 28-11-114-001-00, 28-11-114 002-00 A copy of the proposed Special Use Permit (PUD) Application may be examined at 13235 Center Rd., Traverse City, Michigan, between the hours of 8:00 AM and 4:00 PM Monday through Thursday.
All those who wish to provide materials regarding these standards should do so by submitting them to the Peninsula Township Planning & Zoning Department, 13235 Center Rd. Traverse City, Michigan 49686 not later than 12:00 PM on May 10, 2016.
